Papa has Alzheimer’s. No POA, no recent will. I’ve been taking care of him for almost 2 years. Best of kin will get his assets and house after his death, correct? I’ll be homeless with three kids and going thru a divorce. After losing not just my Papa, but my best friend :( Any advice? Do I have any rights as a caregiver?

Colebucket, so sorry to read that your Dad is in failing health. Even if he has a Will or not, your Dad's assets will need to be filed with the County/City Probate office. A Probate Judge will review the case.

Regarding your parents, am I correct to assume that your parents are still married to each other? Are they separated? If separated for a certain amount of time, maybe the Probate Judge will take that into consideration.

You could plead your case that you were Dad's caregiver for a certain amount of time, thus the Judge could also take that into consideration. The Judge would need to follow State laws.

You wrote that he has "no recent will." Unless laws have changed, it's my understanding that a Will is still in full force and effect unless specifically replaced by another Will, which would contain a clause that the prior Will, dated _______________ is replaced by the new Will (that's not the exact terminology, just the jist of it).

You asked: "Best of kin will get his assets and house after his death, correct?" No, the assets and house would be inherited by those named in his Will. Your statement would apply if he had NO will, thus dying "intestate", and the intestacy laws of the state in which he resided would govern distribution.

Colebucket, is he on Medicaid? They will take the proceeds from the sale of the house. An exception can be made if someone lived in the house and took care of him for at least 2 years.

Next of kin if no will, children will share equally. How many siblings are there?

He is in hospice, almost unresponsive. Diagnosed with Alzheimer’s after a massive heart attack. Was not able to make a will, POA or anything because of his diagnosis. He only has weeks left. :( I’ve been taking care of him for 2 years at his house. My mom has had nothing to do with him. Now she just wants his house, assets, I’ll basically be homeless. I’m also a single mom, going thru a divorce. Thank you for your help!

Papa is still alive? Is he willing to make a will and include you? Would he be willing to sign the house over to you now? Is he in the final stage of the disease?

Is he on Medicaid?

I don't think you have any automatic inheritance rights as his caregiver. It is good to be thinking about this now. I hope Papa is willing and able to compensate you.
