House is in horrific condition. Auction will bring lot value. The house is a tear down. She owes car payment, credit card, heating oil balance, etc. Must turn over Soc. Sec and small pension to NH. Auction is approx. 60 days away. Title must not have any liens on it at time of auction. If the companies she owes get a PA judgement, can they put a lien on the house before the auction? Do I not tell any of them until after?


Once she gets whatever it brings, Medicaid will want "full rate" $9,610/mo. til she spends it all, right? Do all her bills go unpaid even after the house sells? Sorry to sound ignorant, I am her POA and I do not have experience, can't afford an attorney.

thanks everyone. From what we can determine, the timeframe for going to small claims in PA, obtaining a judgment and then filing a lien should take us past the auction date. (and yes it costs money for creditors to do all that) Now i understand when people write about how badly they feel not paying the bills. We are left with no choice but its counter to everything we were taught.

Not to worry about credit card car payment, that is what interest rates others pay is for.

Companies would more than likely put a claim against Estate if probate opened, otherwise they would be out of luck. The bills would go unpaid since her money would go to NH

From what I have been told its costly to put a lean on a house. There is a friends ashes still at the funeral home. Sister took off with the money. Cost to cremate was 2300. To put a lean on friends house would cost 1000. Not worth it. I don't think you are obligated to tell them. Medicaid may not allow you to pay any of the bills owed once house sells. Don't pay them yourself. They may not allow any reimbursements. Companies will just have to take a loss.

i did go to an elder law attorney that was recommended as economical. He wrote a new POA for my relative because her old one had an attorney as POA who had retired and moved. it cost $150 for a pre-made, insert name here POA form and no real additional help. That would have been a second appointment. Her bank manager has been the most help so far. thanks.
