Situation is that my parents and recently myself have been taking care of my Dad's mum who is abusive in nature - has been her whole life? It has been detrimental to my parents general well being. Dad is currently going through chemo and mum has several health conditions. Due to what Dad is going through, I have temporary placed her in a care home, although i know she has been kicking up a fuss. It may be a possibility she returns to our home and I would like to know if there is anyway I legally prevent this?

I'm not sure you need legal resources to keep her from coming back to your home. Just refuse to take her back into your home. Who's going to force the issue? It's your house.

It is a strategy for getting someone into a nursing home - to get them admitted to a hospital, and then to refuse to accept their return to your home. I'm not sure what the law is.

Find information at the local area council on aging: http://www.northbergen.org/Departments/Community/Senior-Programs.aspx

They will know the law or will refer you to someone who does.

Your grandmother's fury will be a big problem. Maybe you can take the role of the bad grandson/daughter who won't let her come home. Then it won't be so hard on your parents.

Is she agitated? Depressed? does she have dementia? Has she been seen by a psychiatrist? There are medications that can help with these kinds of behavioral issues.
