My mom brings in about $3,700 month from VA and SSA both from dad he passed away 30 urs ago he was a Veteran she never re married. She is 83 and lives with me she has no assets meaning house, stocks, car etc. I The house is in my name I own it and I care for her and am her sole caregiver. She is on Hospice and I am wanting to get a break and not wanting in home cargiving prefer a Nursing Home or Assisted Living Center she needs help like showering cleaning herself putting on depends. She can walk short distance with walker she has Dementia. So my question is if she went into Nursing home for the 5 days respite and thigs went well could she stay there and they take all her monies the 3700 month but then how is the rest paid will Medicare or Medicaid, Tricare pay for any part of it? Also would like her to have a Private room I jave found a very nice Nursing Home with Private rooms. Also what is better POA or Durable?

Isn't Tricare a health insurance? If so, it has nothing to do with Medicaid for nursing home care.

What your problem is going to be is that 3700. In my State, the income limit is 2300. Your Mom goes over that. Now is Moms income Dads pension or Aid and Attendance? If A&A, you can't have that and Medicaid too. Since Medicaid is higher the A&A will drop off. If pension, you will need an Elder lawyer to set up a Qualifying Jncome Trust or a Miller Trust if your State allows them. This will take a while before Mom qualifies for Medicaid. So take that 5 day respite now.

You will apply for Medicaid after the attorney sets her up to apply. Right now, she makes to much money and needs that dealt with 1st.

Sorry, when I mentioned doing AG forms I completely spaced that she NEEDS the guidance of a CELA.

The attorney can help set up the appropriate POAs as well. You want to ensure they never expire, that they state they are intended to be valid in any jurisdiction presented and have a back up in the event you can not serve for any reason. Oh and have mom state that she wants you if she is ever required to have a guardian.

I do recommend getting a Durable Mental Health POA, these can NOT be revoked and do give you loads of authority if she turns mental for any reason.

We have 3, Durable General, Health Care and Mental health POAs. Never expiring HIPAA release with the same verbiage is a must have as well. These documents will ensure mom is protected and that you have the authority to help her wherever and for whatever she needs.

I hope it works out well for her stay, then you can be her loving daughter and advocate.

So should I get Durable? Also how do I know if she is on Medicaid? Or will I apply for her when and if she gets in a Nursing Home? Thank you for your help.

I would encourage you to find a certified elder law attorney in your area (www.nelf.org) that can help you understand what help is available with her income and if mom can do a Qualified Income Trust to qualify for medicaid.

This situation is not a DIY.
