An elder lawyer wants to give me her money so she can instantly go on medicaid. It is called loop trust or special needs trust. The problem is we share paying our rent, utilities, food, etc. together. She has a separate SS account and I have a separate SS account, as well. I am on Medicaid and food stamps. If she gives me her money I will have to pay her money she has given to me for her nursing home bill. So, I will not have any of her money at all. I need my food stamps so we can eat. Will they take away my medicaid and food stamps eligibility? Help. Thank you.

I am confused. How much money does Mom have left to pay for her care?

My nephew has a Special Needs Trust because he is physically disabled and to receive services his Moms insurance money was put in the Trust. From what I understand, these trusts can't be set up once your 65 years old. Medicaid oversees these Trusts and get the money upon death.

I agree that taking this money will effect what you receive. Be aware though, if Mom has to stay in LTC and receives Medicaid, its required that her SS and any pension goes toward her care. The only time this does not happen is if there is a Cummunity spouse who needs the monthly income to live on.

Please ask this question on www.bogleheads.org and specify what state you and your mom reside in.

I think you need to be in touch with Social Services in your state to find out what support is available to you once mom's resources are paying for her care.

the lawyer said it is a loop special needs trust. this means if mom gives me her remaining money in her checking account she will be in instant medicaid. however, they will take her whole social security check and will only be given 45.00 a month. mom does not want this and neither do I. she has couple thousand dollars in her account two more months going to nursing home. even if she gave me her money it is not enough to support us with rent, utilities, food, etc. we share rent, utilities, etc. i make 925.00 social security nothing else. i need my food stamps. they will take them away if i get mom's remaining money. a relative yell to me to find another place to live. it dosen't seem like i'm going to get help. i may take mom home and get aid 4 hours day. the problem is she can't walk right now. they are going to reevaluate her pt Jan since she used all her 2022 part a part b which covers it. they get her out of bed with hoyer lift when she gets out of bed that is. they don't get her out of bed all the time. Did anyone else have these issues?

The elder lawyer should know the best way to handle her money and how it effects both her and your Medicaid eligibility. What did the lawyer say to you as to how you would be affected? I think what the lawyer is doing is setting it up so you will be able to survive on your own if you need your mother's income to help pay the rent. I would follow the attorney's direction.
