Hi, can anyone tell me how it goes if I am power of attorney for my mother? She has another daughter who hasn’t spoken to her for over 20 years. My mother has not made a will. Does my sister automatically get any money that is left when my mum passes?
Here in the U.S., the two of you would split the estate if your mom dies without a will. Is she not competent to make a will now?
my grandmother had three sons, but was estranged from one of them and didn’t have a great relationship with a second one. In her will she left 2/3 of her estate to my dad, 1/3 to her oldest son, and $.10 to her youngest son, because she wanted to make it clear that she had not forgotten to include him in the will, she just didn’t want him to receive anything. The fact that she had no assets, lived in a house my dad owned and my dad supported her was irrelevant to her -- she wanted the world to know she'd disowned her youngest son.
If your mom is able to make a will and doesn't want her other daughter to inherit anything, then she needs to get that in writing or a court will likely decide how her estate is distributed.
