No, brother needn't be consulted but a lawyer should be. If you have a troublesome brother then he can cause all sort of grief by bringing up a case with APS claiming all sorts of lies like theft, etc. Also, the Elder Care Attorney can guide you in what to do and what not to do. You should understand what costs come under her cost of living and what comes under payment to you as salary and reportable. Mom's funds can pay for this. You should also have and understand POA, and that that also is not the brother's business.
