Do you require parents permission to list minors on a Affidavit of facts concerning the identity of heirs.This will be lodged with the county clerk.
Further information father passed away and mother never removed his name from the title. Some siblings have passed away so their children need to be listed as per instructions.This is Texas.

Your county clerk can answer that question for you. My ILs will did not "extend" to their deceased childrens' children, only living children of my ILs could inherit. The county judge didn't require information on any of the grandchildren.

Yes, the County Clerk can answer this question.

Also, you may need to check the laws of your State if there is no mention in the Will that if a Beneficiary has died prior to the parent how is the estate handled if not mentioned in the Will. The Will should be written up either "if one of the beneficiaries mentioned has died prior, his/her children will inherit his part of the inheritance" or "if one of the beneficiaries has died prior, the inheritance is split among the surviving beneficiaries" something to that effect. When my husbands Uncle died, his estate was left to his siblings. If his siblings died prior to his death, the nieces and nephews would inherit their parent's part of the inheritance. My MIL was deceased and her 3 sons inherited her portion.
