I am POA for my dad with dementia, who often tells other family members he wants to give them gifts. At the holidays, he wants to give some gifts to family and caretakers.


He currently does not qualify for Medicaid, but probably will in the next year or two.


What happens if he buys modest presents for people now?

I see no problem if its modest. But when he is in a NH with Medicaid he won't have the money to spend. Even if he has 2k or less in the bank, it has to be used for him.

My dad is currently private pay in NH. Once he qualifies for Medicaid, there is a 5 year look back. Our attorney told us that Medicaid typically does not look at anything under $1,000. We are in New York State. Once on Medicaid, no more gift giving.
