I have been the primary care giver of a parent and have had a lifetime of difficulty with older siblings - they assume I have no authority but bear all the responsibility. Because they have been involved in a lot of unscrupulous financial activity against my parents, they have now projected that upon me and made false accusations which will eventually reach the dept of aging in an appeal process. Can anyone advise a good attorney that specializes in this?

You will need a criminal defense attorney if this is being prosecuted. You should start calling ones in your area, they are happy to tell you if they can help or not.

Look in your local area for an elder law attorney.
However, if you are POA and have kept meticulous records of every penny into and out of mom's accounts you are free and clear and should simply be open to investigation.
You can also ask APS about the advisability of your getting an attorney IF they come to call.
Do know if the siblings begin to mess with this and it goes to court, and there is a huge sibling squabble then the care and guardianship of your mother will likely be moved to the state. With a lifetime of this I imagine you are tired and this may be the very best outcome?

I would not get a lawyer until Adult protection services does an investigation. They do not take accusations to heart. If you can show how you have used parents money, thats one hurdle. Is your parent clean, fed and cared for? The house is clean, not immaculate but clean? APS may find no truth to the accusations and dismiss them. Thats in your favor in case siblings try to bring charges again. If you are prosecuted, and I think it would have to be really horrible care to do this, then you get a lawyer. It also might work out that you are given resources to take advantage of.

Thank you for reply. This is a sordid mess. I am not the POA. Because of financial advantage other family members were taking with my parents, An outside POA was hired - who took an enormous amount of money without transparency -and was fired. The APS has been very biased Against me and spurring the false allegations in favor of the siblings. my parent is in beautiful shape and living conditions and that has been obvious to APS since they have visited several times. they are not acting professionally nor responsibly but harassing me and father with unwarranted visits and investigations. requiring expense in hiring attorneys And stress for me and father.
Smaller town -much collusion -very difficult to find an attorney and legitimacy with this agency.

Daniel, given your response to JoAnn below I need to tell you that given that this is an ongoing family dispute over care of an elder, with a long and convoluted history, we here are unlikely to be able to advise you.

YOU would be the one to know what legal help is in your town, not us.
We can only offer you our sympathies in a case we cannot know whether you are right or you are wrong.

Good luck.
