ive been a caregiver to my client for about 7 years already and his wife is in bad shape in the hospital .all she left was a letter stating what she wanted for her husband if one day she were to pass .in that letter states me to be the guardian for her husband because sending him to a home was never her option . and I'm simply asking since he himself doesn't have a guardian would I be able to be his gaudian ????

Are you a professional caregiver? That may matter as to what your options may be. If you are employed by an agency, I might consult with them. If not, a legal opinion from an attorney might be in order. Does the couple have adult children, siblings, or other family members who are in contact? A court would determine if a Guardian is needed and if so, who would be the best person to serve.

Even if you were granted guardianship I think there may be some difficulty with a non family guardian paying themselves to be a caregiver, and since you need to earn a living you need to be able to do that.

Yes I a am cna..and no he himself don't have any family members the wife was just the rep for him .he has no poa no guardianship for himself he has dementia and Parkinson's. The wife's family doesn't want anything to do with him .so I mean what is there to do in a situation like this .all she left was a letter stating what she wanted if she were to pass away .
