I am the only caregiver for my 81 year old Mother. She has later stage Alzheimers Disease. I have been taking care of her for more than five years. She awarded me POA in 2003 and again in 2009. My Abusive Alcoholic brother who lives two doors down, kicks me out of the house at his will. I do nothing to warrant this and since he went behind my back and got guardianship of my Mother, he Lords his power over me. He has hit me over the head with a taser baton and caused 9 stitches, he beat me last March while I was sleeping on the couch one early morning. He busted my ear drum, broke my jaw and cut my eye. I've been threatened more than twice with a gun. I quit my job and moved home from Boston back to eastern Kentucky just to take care of my Mother. She can only Identify me and get's agitated and panicked if I am out of the house. He usually kicks me out of my Mothers home during the winter months and I've had to sleep on the streets on two separate occasions. What are my legal rights and what can I do. Is he allowed to make me leave the house where I take care of my Mother?
A guardian is in charge. Your mother no longer has the right to decide how her money is spent or where she lives or who lives with her. The guardian does. Your POA no longer has the authority it did before a guardian was appointed.
HandsomePilot, I hope that you are sincerely a caregiver and in search of interacting with other caregivers. This whole story seems strange ... but sometimes truth is strange.
Can you give us an update of this situation? Is your brother still the guardian? Are you still caring for your mother?
Why does he kick you out of the house? Does HE want to care for your mom? What other ways does your brother exercise his guardianship over your mom? Why did he get guardianship? Is he in it for the money?
Does your brother own the house your mom lives in? Why does he think he has the power to kick you out? If he had no claim on the home- Change the locks, don't open the door when he comes to visit. See a lawyer your (& your moms) paperwork in order! He has guardianship and you have POA? I Think the guardianship wins BUT see a lawyer. Also by calling the police every time he assaults you, you are documenting how unfit he is to hold the guardianship.
