No. There has to be an asset, like a home. A house is an exempt asset while living. Once there is a death, a lean is placed on the house. If you both own it, its on the recipients half. Medicaid will not recover until the Community Spouse dies or sells the house. When the Community Spouse dies, it will be up to family to sell the house. Medicaid does not take houses.
